The State Administration for Market Regulation has released the "Guidelines for Compliance with Pricing Behavior in the Automotive Industry (Draft for Comments)", aimed at regulating pricing behavior in the sale of new cars. The guidelines detail the rules for clear pricing, requiring accurate representation of product information and prohibiting additional charges; regulate promotional activities, requiring the disclosure of promotional rules; clarify forms of price fraud, prohibiting misleading pricing; establish a risk warning mechanism, encouraging risk warnings for low-price behaviors; and regulate service charges, prohibiting charges for no service and duplicate charges
Focusing on the new car sales segment, efforts are made to regulate prominent issues such as failure to clearly mark prices and false promotions. First, the rules for clear pricing are refined, requiring that business locations and online platforms accurately and truthfully display product and service information, strictly distinguishing between the prices of automotive products and sales service prices, and prohibiting additional charges beyond the listed price. Second, promotional behaviors are standardized, requiring significant public disclosure of promotional rules, time limits, and restrictions, as well as truthful indication of gift information. Third, forms of price fraud are detailed, clearly prohibiting misleading pricing, false comparative pricing, and failure to fulfill price commitments. Fourth, a risk warning mechanism is established, encouraging platforms to provide dual warnings of operational and consumer risks for significantly low-priced behaviors. Fifth, service charges are standardized, prohibiting charging without providing service, double charging, and shifting charges.
